The Economic and Financial Crimes Commission (EFCC) charged the two men alongside their company, Crius Chemical Nigeria Limited, for violating Section 134(b) of the Nigerian Minerals and Mining Act, 2007. This section criminalizes the illicit modification of ore, an offense punishable by two years of imprisonment or a N500,000 fine. Both convicts admitted their guilt, leading to the judge’s ruling after a witness and evidence were presented by the prosecuting counsel, Sesan Ola.
